These Terms & Conditions (“Terms”) govern your use of the ToTo Food website, mobile application, and related services (collectively, the “Platform”), operated by ToTo Food Technologies Ltd. (“ToTo Food”, “we”, “us”, or “our”) in Bangladesh.
By creating an account, placing an order, or using any part of the Platform, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy.
User/You: Any person who uses the ToTo Food Platform.
Merchant: A restaurant, home kitchen, cloud kitchen, food business, or other seller listed on ToTo Food.
Rider/Delivery Partner: A person who provides delivery services through the ToTo Food Platform.
Order: A request placed by a User to purchase food or other products through the Platform.
Services: Food browsing, ordering, payment processing, delivery coordination, tracking, customer support, and related services.
You must be at least 18 years old to independently use the Platform. Users below the applicable age must use the Platform with the consent and supervision of a parent or legal guardian.
You are responsible for providing accurate and up-to-date account information and for keeping your login credentials secure.
You are responsible for all activities performed through your account. ToTo Food may suspend, restrict, or terminate accounts involved in fraud, abuse, suspicious activity, or violations of these Terms.
ToTo Food provides a technology platform that connects Users with Merchants and facilitates food ordering and delivery services.
The Merchant is responsible for preparing the food, menu information, ingredients, food quality, availability, and applicable product information. ToTo Food may provide delivery through its Riders or coordinate delivery through the Merchant.
Menu items, descriptions, availability, and prices are provided by Merchants and may change without prior notice.
The total amount payable will be displayed during checkout and may include food prices, applicable taxes or VAT, delivery charges, service charges, discounts, and optional tips.
Promotional offers and discount codes may have specific eligibility requirements, usage limits, expiration dates, and other conditions. ToTo Food reserves the right to cancel or withdraw promotions in cases of misuse, fraud, or technical errors.
When you place an Order through the Platform, you are submitting a request to purchase the selected items from the relevant Merchant.
An Order becomes confirmed when the Merchant accepts it through the Platform. Until confirmation, the Merchant may accept or reject the Order based on availability, operating hours, location, or other circumstances.
ToTo Food may contact you regarding your Order if additional information or confirmation is required.
You may request cancellation before the Merchant begins preparing your Order. Cancellation may not be possible once food preparation has started.
If an Order is canceled after preparation has started, you may be charged for some or all of the Order value depending on the circumstances.
Changes to an Order after submission are not guaranteed and may depend on the Merchant's ability to accommodate the requested changes.
If a Merchant cancels an Order or an ordered item becomes unavailable, ToTo Food may notify you and provide an appropriate refund for undelivered items where applicable.
Delivery times shown on the Platform are estimates and may vary depending on food preparation time, traffic, weather, road conditions, restaurant workload, location, and other circumstances.
Users must provide an accurate delivery address and remain reasonably available at the provided phone number and delivery location.
If a Rider is unable to complete delivery because of an incorrect address, unavailable recipient, unreachable phone number, or other circumstances caused by the User, the Order may be canceled and a refund may not be available.
Where available, Users may track their Order through the Platform.
If ToTo Food offers a 30-minute delivery guarantee for a specific area, restaurant, Order, or promotional campaign, the applicable terms and conditions of that offer will apply.
Delivery estimates may be affected by traffic, weather, restaurant preparation time, incorrect delivery information, customer availability, force majeure events, or other circumstances outside ToTo Food's reasonable control.
Any “late delivery” compensation, including free food or other benefits, will only apply where the specific Order qualifies under the applicable guarantee terms.
Food is prepared and supplied by Merchants. Merchants are responsible for food quality, ingredients, preparation, packaging, and allergen information.
Restaurants and kitchens may handle common allergens, and cross-contact cannot always be completely prevented.
If you have a food allergy, dietary restriction, or other food-related concern, please contact the Merchant or ToTo Food support before placing your Order.
You may pay using the payment methods available during checkout, including applicable cards, mobile financial services, cash on delivery, or other supported payment methods.
By placing an Order, you authorize the applicable payment provider to process the total amount shown at checkout.
Payment processing may be handled by authorized third-party payment providers. Their own terms and privacy policies may also apply.
If you receive a missing, incorrect, damaged, or significantly problematic Order, please contact ToTo Food support as soon as reasonably possible with your Order number and relevant details.
Refund requests will be reviewed based on the circumstances of the Order. Approved refunds may be returned through the original payment method or, where available and with your consent, provided as ToTo Food credits.
Refund processing times may vary depending on the payment provider.

Users may submit reviews, ratings, photographs, comments, and other content where such features are available.
You retain ownership of content you submit. However, by submitting content to ToTo Food, you grant ToTo Food a non-exclusive, worldwide, royalty-free license to use, reproduce, display, modify, and distribute that content for operating, improving, and promoting the Services.
ToTo Food may remove content that is unlawful, misleading, abusive, inappropriate, fraudulent, or violates these Terms.
The ToTo Food name, logo, trademarks, website, mobile application, design, software, graphics, text, and other Platform content are owned by ToTo Food or its respective licensors.
You receive a limited, non-exclusive, non-transferable, and revocable right to use the Platform for its intended purpose.
You may not copy, reproduce, modify, distribute, reverse engineer, sell, lease, or commercially exploit any part of the Platform without prior written permission.
By using ToTo Food, you agree to receive necessary service-related communications, including Order confirmations, delivery updates, account notifications, security alerts, and important legal notices.
Where permitted, we may also send promotional messages, offers, and marketing communications. You may opt out of promotional communications through the available unsubscribe or account settings.
ToTo Food collects and uses information necessary to operate the Platform, process Orders, provide delivery services, communicate with Users, prevent fraud, improve our services, and comply with applicable laws.
Our collection and use of personal information are described in our Privacy Policy, which forms part of these Terms.
We aim to keep the Platform available and operational, but we do not guarantee uninterrupted or error-free access.
The Platform may occasionally be unavailable due to maintenance, technical issues, network problems, power outages, natural disasters, severe weather, government actions, strikes, emergencies, or other events beyond our reasonable control.
The Platform and Services are provided on an “as available” and “as is” basis to the maximum extent permitted by applicable law.
ToTo Food does not guarantee that the Platform will always operate without interruption or that all information provided by Merchants will always be complete, accurate, or available.
To the maximum extent permitted by the laws of Bangladesh, ToTo Food will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from your use of the Platform.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable Bangladesh law.
You agree to indemnify and hold harmless ToTo Food Technologies Ltd., its officers, employees, representatives, partners, and service providers from claims, losses, damages, liabilities, and reasonable expenses arising from your violation of these Terms, misuse of the Platform, or unlawful conduct.
ToTo Food may suspend or terminate your account or restrict access to the Platform if we reasonably believe that you have violated these Terms, engaged in fraudulent activity, abused the Services, or created a security or legal risk.
You may stop using the Platform and request account deletion subject to applicable legal and operational requirements.
We may update these Terms from time to time to reflect changes in our services, technology, business practices, or legal requirements.
Updated Terms will be posted on the Platform with a revised “Last Updated” date. Continued use of ToTo Food after the updated Terms become effective means that you accept the revised Terms.
These Terms are governed by and interpreted in accordance with the laws of Bangladesh.
Subject to any mandatory rights available under applicable law, disputes arising from or relating to these Terms or the Services shall be subject to the jurisdiction of the competent courts in Dhaka, Bangladesh.
